CHIVAL 

1. Definitions
1.1. In these General Terms and Conditions, the following terms are used with the meanings given to them in this section:

  • Order: The order you place via the CHIVAL Website.
  • You/your: The consumer who uses the CHIVAL Website and/or purchases products via the Website.
  • Gift card(s): The gift card(s) issued by CHIVAL.
  • Agreement: The agreement under which you purchase products via the CHIVAL Website.
  • Product(s): The products offered by CHIVAL on its Website.
  • CHIVAL/we/us/our: The private limited liability company CHIVAL, having its registered office and principal place of business at De Perponcherstraat 60, The Hague, registered with the Chamber of Commerce under number 77320662.
  • Terms: These general terms and conditions that apply to the Agreement.
  • Website: The official CHIVAL website, accessible via www.chival.nl and any possible variants thereof.

2. The Agreement
2.1. These Terms apply to your use of the CHIVAL Website, all CHIVAL offers, and to every Agreement concluded.

2.2. The Terms are made available to you via the Website before the Agreement is concluded. The Terms can be downloaded at any time.

2.3. All offers by CHIVAL, whether made orally, in writing, or by telephone, are without obligation, unless stated otherwise. The Website does not contain binding offers, unless explicitly stated.

2.4. An Agreement is concluded once CHIVAL has provided a written or electronic confirmation, based on the information you have provided. You guarantee that this information is correct.

2.5. CHIVAL processes and collects personal data in accordance with the privacy and cookie statement available on our Website.

2.6. CHIVAL reserves the right to unilaterally amend these Terms. The amended terms also apply to existing Agreements, unless the amendment is detrimental to you. In that case, you have the right to terminate the Agreement free of charge within 14 days of being notified of the change.

3. Orders
3.1. By placing an Order on the Website, you agree to these Terms. After placing your Order, you will receive a

3.2. A valid email address is required to place an Order. 

  • Cancellation or modification: After receiving the confirmation email, you have 4 hours (during office hours) to cancel or modify your Order, depending on availability and the type of Product. Specific conditions may apply during campaigns or promotions.

3.3. CHIVAL reserves the right to modify or cancel an Order.

3.4. If an Order cannot be delivered, you will be informed as soon as possible. If payment has already been made, the amount will be refunded via the original payment method.

3.5. The order confirmation states the total price including taxes and shipping costs, unless stated otherwise.

4. Payment and Prices
4.1. All prices on the Website include VAT and other taxes, but exclude shipping costs and customs duties for deliveries outside the EU.

4.2. If costs increase after the Agreement has been concluded due to external factors such as higher taxes or purchase prices, CHIVAL has the right to adjust the prices. In that case, you have the right to dissolve the Agreement.

5. Delivery and Ownership
5.1. The delivery times indicated by CHIVAL are indicative. If the delivery period is exceeded by more than 4 weeks from the purchase date, you have the right to cancel the Agreement.

5.2. The Products are delivered at CHIVAL’s risk. The risk passes once you or a designated third party has received the Order.

5.3. You are obliged to accept the Ordered Products at the time of delivery.

5.4. If payment is not made on time, CHIVAL may postpone delivery until all amounts due have been paid in full.

5.5. Ownership of the Products remains with CHIVAL until all claims have been paid in full.

6. Right of Withdrawal
6.1. You have the right to cancel your Order within 14 days of receiving the Products without giving any reason, with the exception of specific Products such as custom-made items or gift cards.

6.2. For Gift cards, a right of withdrawal applies within 14 days of concluding the Agreement, regardless of whether you have already received the Gift card.

6.3. Returns must be sent back to CHIVAL within 14 days of exercising the right of withdrawal, with the return shipping costs at your own expense.

7. Warranty
7.1. CHIVAL guarantees that the Products comply with the Agreement and with generally applicable quality standards.

7.2. Complaints must be reported in writing within 14 days after discovering a defect.

7.3. CHIVAL offers a 6-month warranty on most Products, excluding signs of use or normal wear and tear.

8. Intellectual Property
8.1. All rights to the Products and content on the Website belong to CHIVAL or its licensors. It is prohibited to use these without CHIVAL’s permission.

9. Website Use
9.1. The Website may only be used for private purposes. Commercial use of the Website is prohibited.

9.2. It is not permitted to copy, distribute, or use the content or materials on the Website for other purposes without CHIVAL’s permission.

10. Disputes and Applicable Law
10.1. Disputes must first be resolved via customer service. If a dispute is not resolved to your satisfaction, you can use the ODR platform.

10.2. All Agreements are governed by Dutch law. The Vienna Sales Convention does not apply.
